General Terms and Conditions 

The General Terms and Conditions govern the relationship between the Buyer and the Seller regarding the terms and methods of ordering products, product prices, payment conditions and methods, warranty conditions for the sold items (known as guarantees), 

the Buyer’s rights to file written complaints about the Seller’s products and services, the right to terminate the contract, product delivery, and other services offered by the Seller, personal data protection, and other important matters related to the conclusion of a purchase agreement through the Internet store. 

The Terms and Conditions are subject to the Consumer Protection Act, the Electronic Commerce Act, the Obligations Act, and other applicable regulations of the Republic of Croatia. The Seller reserves the right to amend the Terms and Conditions at any time. All amendments will be published on the Seller’s website and will take effect immediately upon publication on the website. Any changes to the Terms will apply to purchases made after the publication of those changes. 

The Buyer is responsible for reviewing the valid Terms before each purchase. Prior to making a purchase, the Buyer declares in the application that they have read these General Terms and Conditions and accept them. Upon confirming the order, the same will be provided to the Buyer as the content or attachment of the email confirming the conclusion of the contract. These Terms are available to service users at any time, allowing them to save, reuse, and reproduce them. These Terms and conditions are considered an integral part of each purchase agreement concluded between the Seller and the Buyer through the Internet store.

Buyer

The Buyer of the products is any individual who purchases products through the Internet store in accordance with these General Terms and Conditions, i.e., who selects at least one product, adds it to the cart, pays by credit/debit card, e-banking, and sends the order to the Seller. 

The Buyer can only be a legal adult and capable person. The contract on behalf of and for the account of a minor and fully legally incapacitated person can be concluded by their legal representatives or guardians. Partially legally capable individuals can conclude a contract only with the consent of their legal representatives or guardians. The Seller bears no responsibility for any actions contrary to this provision. 

Age restrictions 

The sale of alcoholic beverages to persons under the age of 18 is prohibited. Every buyer is required to present a document proving their legal age upon request of the delivery person. 

Placing Orders 

Products are ordered via an electronic form. The webshop is always open for ordering, and there are no specific working hours for orders. Orders are processed on business days from 8:00 am to 4:00 pm. The Buyer needs to complete the “Profile with Basic Information” for billing and delivery of the desired products, and they will be notified of the completed order by email. 

To purchase the desired product, click “Add to Cart.” In the cart, you can choose quantities or cancel the purchase. After selecting the desired items, click on the cart and choose “Checkout.” On the checkout page, fill in your information, select the delivery method, then the payment method, and choose “Place Order.” A notification of a successful purchase will be sent to your email address. 

Sulet grupa d.o.o. undertakes to deliver all ordered products that are available in stock at the time of delivery. If Sulet grupa d.o.o. is unable to deliver any of the ordered products, they will contact the buyer by phone or email. All other ordered products will be delivered. 

Prices 

The prices listed on the website are retail prices, including VAT and a refundable deposit of 0.07 € (0.50kn). 

Payment

Payment can be made in the following ways: 

One-time payment by credit cards (Mastercard®, Maestro®, Visa) directly through our webshop. The credit card payment service is provided by CorvusPay, ensuring the security of your data. 

Statement on Conversion 

All payments will be made in Croatian currency. The charged amount on your credit card statement will be converted into your local currency based on the card association’s exchange rate. 

Delivery 

We deliver goods via the DHL courier service to all addresses within Croatia and to the offered countries in the menu. 

Standard delivery in Croatia 

The minimum order for products in Croatia is 53.22 € (401.00 HRK). 

International standard delivery 

The minimum order for Zone 1, Zone 2, Zone 3, and Zone 4 is 58.13 € (438.00 HRK).

Unilateral Termination of the Contract

Calculation of the Deadline for Unilateral Termination of the Contract The Buyer has the right to unilaterally terminate the contract without stating a reason. In order to exercise the right to unilateral termination of this Contract, you must notify us of your decision to unilaterally terminate the contract before the deadline, through an unambiguous statement (Declaration Form) sent by mail to the address Sulet grupa d.o.o., Pod Kosom 45, 21 000 Split, Croatia, or by email to info@markuswines.com, in which you will state your full name, address, telephone number, and email address. 

The deadline for unilateral termination is 14 days from the day on which the goods subject to the contract were delivered to you or to a third party you have designated, other than the carrier, who has acquired possession of the goods. 

Refund of the Paid Amount If you unilaterally terminate this Contract, we will refund all payments received from you, including the delivery costs, without undue delay and no later than 14 days from the day we received your decision to unilaterally terminate the contract. However, we will not process the refund until the goods are returned. 

The refund will be made using the same payment method you used for the initial transaction. In case you agree to a different method of refund, you will not incur any fees related to the refund. 

Return of Goods In the event of unilateral termination of the contract, the consumer bears the direct costs of returning the goods and is obliged to return the goods to Sulet grupa d.o.o. undamaged, without undue delay, using postal services, together with the invoice, no later than 14 days from the day the consumer notified the trader of the unilateral termination of the contract. The consumer is considered to have fulfilled their obligation on time if they have sent the goods to the trader before the expiration of the aforementioned deadline. The consumer is responsible for any diminished value of the goods resulting from the handling of the goods, except for what was necessary to determine the nature, characteristics, and functionality of the goods. Sulet grupa d.o.o. is obliged to refund the consumer without undue delay and no later than 14 days from the day of receiving the consumer’s notice of unilateral termination of the contract, but not before the goods are returned. If the consumer has diminished the value of the goods by handling them, Sulet grupa d.o.o. has the right to proportionately reduce the amount to be refunded to the consumer. Sulet grupa d.o.o. is not obliged to accept the return of goods if the returned goods are damaged and not suitable for further sale. 

Costs of Return of Goods The consumer bears the direct costs of returning the goods using postal services or a delivery service, according to their price list.

Replacement of Damaged Goods If damage occurs during the transport of the goods, Sulet grupa d.o.o. will replace the damaged items at its own expense or refund the paid amount no later than 14 days from the day of receiving information about the damaged items. The refund will be made using the same payment method you used for the initial transaction. In case you agree to a different method of refund, you will not incur any fees related to the refund. 

Replacement of Incorrectly Delivered Goods or Goods with Material Defects If incorrect items or items with defects are delivered, Sulet grupa d.o.o. will replace the items at its own expense or refund the paid amount no later than 14 days from the day of receiving 

information about the incorrect items or items with defects. The refund will be made using the same payment method you used for the initial transaction. In case you agree to a different method of refund, you will not incur any fees related to the refund. 

Refund of Funds 

If, for any reason, we do not have the goods you have paid for in stock, we will refund the funds within 24 hours. We may contact you to inquire if you would like the remaining order to be shipped. We will strive to update the offer daily so that if something is not available, it will be blocked for ordering to minimize the possibility of errors. 

Errors in Pricing Errors may occur in the pricing system. In such cases, the seller is not obliged to deliver the products at a price so low that the buyer knew or should have known it was an error and not the actual price of the product. 

Product Images The product images are symbolic, and the vintage on the label of the product may differ from the currently available vintage stated in the product specifications. 

Privacy Statement 

Sulet grupa d.o.o. is committed to protecting the personal data of customers by collecting only necessary basic customer information required for fulfilling our obligations. We inform customers about the use of collected data, regularly provide them with the opportunity to choose how their data is used, including the option to remove their name from marketing campaign lists. All customer data is strictly kept and only accessible to employees who need it for their work. All employees of Sulet grupa d.o.o. and business partners are responsible for respecting the principles of privacy protection. 

Collection and Processing of Personal Data

By registering on the website www.markuswines.com, the Buyer gives personal consent for the collection, use, processing, and transmission of their personal data necessary for using the website, including (but not limited to): 

Consent for the Seller to process the provided personal data in accordance with the provisions of the Personal Data Protection Act, for the purposes of maintaining records and statistics, creating a customer database, notifying about products and services, informing about delivery, sending promotional materials, improving customer relationships, and improving services. The Seller may provide the mentioned data to third parties for the purpose of providing services, protecting the interests of users and the Seller, and preventing any misuse. 

The need to gain better insight and understanding of individual customer needs and requests and to develop possibilities for providing high-quality Seller services that result in increased customer satisfaction. 

Consent for the Seller to contact the customer in writing, by telephone, SMS, and/or email, and to send materials to the customer’s address to inform them about benefits and news in their offer. 

Provision of data to third parties necessary for the fulfillment of the above mentioned purposes. 

The Seller undertakes to protect the privacy of all customer data and to handle it in accordance with the Personal Data Protection Act and other applicable regulations of the Republic of Croatia. The Seller is not authorized to use or make personal data available to third parties, except in cases where a specific law allows it or when it is necessary to fulfill contractual obligations. All employees of the Seller and business partners are responsible for respecting the principles of privacy protection. 

If a user/customer does not want the Seller to process their data in any way and requests the deletion of their data, they must inform the Seller by sending an email to info@markuswines.com. 

Notice on filing a written consumer complaint

In accordance with the provisions of article 10 of the Consumer Protection Act (Official Gazette No. 19/2022) we are informing consumers of how to file written complaints concerning the provided services:

The seller is obligated to confirm the receipt of the consumer’s written complaint without delay.

The seller will respond in writing to the consumer’s complaint within 15 days of receiving the complaint. For this purpose, please indicate your name, surname, content of the complaint, and your address/ email address.

We kindly ask you to inspect the goods immediately after receiving them, because we will not be able to accept subsequent complaints.
